O-1A Visa
The O-1A visa is a nonimmigrant U.S. work visa for individuals with extraordinary ability in the sciences, education, business, or athletics who have demonstrated sustained national or international recognition in their field. Unlike immigrant categories such as EB-1A, the O-1A is temporary and requires a U.S. employer, agent, or sponsor to file the petition on the applicant’s behalf, although the evidentiary standards are similar. Applicants generally must show either receipt of a major internationally recognized award or meet at least three regulatory criteria, such as original contributions of significance, scholarly publications, critical roles for distinguished organizations, high salary, judging the work of others, or published material about their achievements. The visa is commonly used by researchers, startup founders, executives, engineers, and other highly accomplished professionals seeking to work in the United States on specific projects or employment engagements.
