The EB-2 National Interest Waiver (NIW) is a U.S. employment-based immigrant visa category that allows certain professionals with advanced degrees or exceptional ability to apply for a green card without needing a specific job offer or labor certification if they can show that their work has substantial merit and national importance to the United States. Under the framework established by the Matter of Dhanasar decision, applicants generally must demonstrate three things: that their proposed endeavor has national importance, that they are well positioned to advance it, and that waiving the normal job offer and labor certification requirements would benefit the U.S. The category is commonly used by researchers, engineers, physicians, entrepreneurs, and technology professionals whose work contributes to areas such as science, healthcare, national security, infrastructure, or economic competitiveness.
