You Got an RFE. Now What?

What an RFE actually means

USCIS is telling you exactly where the petition fell short of convincing them. That is useful information — it narrows the fight to specific issues instead of leaving you guessing. It is not a verdict. It is an invitation to close the gap with better evidence and a clearer argument.

Read the RFE like a map

Start by identifying precisely which criteria, or which part of the Final Merits Determination, is being questioned. Then distinguish “you did not prove X” from “X is not enough.” The first needs more evidence; the second needs reframing and stronger argument. Note the deadline and the requested format carefully — missing the deadline is fatal, and most RFEs allow only a single response.

How to build a winning response

A strong reply does four things:

• Addresses every point raised, in order, explicitly — do not make the adjudicator hunt.
• Adds new, targeted evidence rather than repeating what was already filed.
• Strengthens the narrative, not just the documents; if the FMD was the issue, reconnect the evidence to a single coherent claim about your standing.
• Includes a clear cover argument that walks the adjudicator through how each concern is now resolved.

What not to do

Do not dump volume — more of the same evidence rarely answers the actual question. Do not argue emotionally or dispute the adjudicator’s right to ask. And never miss the deadline or respond only partially. One strong, complete response beats a fast, thin one every time.

Bottom line: An RFE tells you exactly what stands between you and approval. Answer every point with targeted evidence and a sharpened narrative — and treat it as the opportunity it is.
